This means that I am not responsible if you're browsing around and the site damages you or your computer or infects it with any nasty viruses. I try to make sure this doesn't happen but I don't make any guarantees that it won't.

You'll probably notice I've linked my site to lots of others. That doesn't mean I've looked at all those sites and I don't check them out periodically to see what's going on. If some site you link to is bad or has stuff on it that offends you, you're doing it at your risk.

The terms of use agreement is subject to change and visitors of my site have an affirmative duty as part of the consideration for permission to view this site to keep themselves informed of changes.

This Agreement is governed by the laws of the State of Kansas, without regard to principles of conflict of laws.

All disputes will be resolved as follows:

If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Bourbon County. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Bourbon County, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.

In no case shall the viewer, visitor, subscriber or customer have the right to go to court or have a jury trial.  Viewer, visitor, subscriber or customer will not have the right to engage in pre-trial discovery except as provided in the rules; you will not have the right to participate as a representative or member of any class of claimants pertaining to any claim subject to arbitration; the arbitrator's decision will be final and binding with limited rights of appeal.

The prevailing party shall be reimbursed by the other party for any and all costs associated with the dispute arbitration, including attorney fees, collection fees, investigation fees, travel expenses.
